Guitar Paradise – Terms & Conditions

Welcome to Guitar Paradise (www.guitarparadise.com.bd). By accessing or using our website and purchasing our products, you agree to be bound by these Terms & Conditions. If you do not agree with any part, please do not use the site.

1. Definitions & Interpretation

  • “We”, “us”, “our”, “Guitar Paradise” refers to the owner/operator of the website and seller of products.

  • “You”, “your”, “Customer” means any person who visits, browses, or purchases from the site.

  • “Site” means www.guitarparadise.com.bd and related mobile or web interfaces, services, tools.

  • “Products” means musical instruments, accessories, and other goods we list and sell.

  • “Order” means your request to purchase one or more Products via the Site.

Unless the context requires otherwise, singular includes plural, headings are for convenience only and do not affect interpretation.

2. Acceptance & Changes

  • By using the Site, placing an Order, or accessing content, you accept and agree to these Terms & Conditions and our Privacy Policy.

  • We reserve the right to modify or update these Terms & Conditions at any time. Changes will become effective when posted on the Site. Your continued use after changes constitutes acceptance.

3. Your Account & Security

  • You may need to create an account to place Orders. The information you provide must be correct, complete, and kept up to date.

  • You are responsible for maintaining confidentiality of your login credentials. You agree to notify us immediately of any unauthorized use or breach of security.

  • We reserve the right to suspend or terminate your account, refuse or cancel Orders, or require identity verification, at our discretion, without liability.

4. Products, Pricing & Availability

  • We strive to display accurate information (price, specifications, stock), but errors may occur.

  • Prices are in Bangladeshi Taka (BDT) and include VAT where applicable (unless otherwise stated).

  • Placing a Product in your cart does not reserve it at that price or guarantee availability.

  • We may change prices or availability at any time before your Order is confirmed.

  • We reserve the right to refuse or cancel any Order for reasons including mispricing, stock unavailability, or technical errors. If we cancel, any payment made will be refunded as per our Refund Policy (see below).

5. Order, Contract & Payment

  • When you place an Order, you are making a binding offer to purchase. We reserve the right to accept or reject that offer.

  • A contract is formed when we dispatch (ship) the Product(s) to you (not when you click “confirm”).

  • We support various payment methods (e.g., bKash, bank transfers, card payments). Payment must be cleared before shipment.

  • In the case of payment issues or suspected fraud, we may require additional verification or cancel the Order.

6. Shipping & Delivery

  • We will deliver Products to the address you provide, within the delivery areas we serve.

  • Delivery times are estimates. We are not liable for delays caused by third-party logistics, weather, force majeure, public holidays, etc.

  • You must inspect the package upon receipt and notify us promptly of any visible damage, missing items, or mismatch.

7. Returns, Refunds & Warranty

  • We provide a return/refund policy (see our Returns & Warranty Policy).

  • Returns are accepted under specified conditions (e.g., unused, original packaging, within stated return window).

  • Refunds will be processed to your original payment method (or as otherwise agreed) in a reasonable time.

  • Products may carry manufacturer warranties. Our obligations are limited to what we state in those terms.

8. User Conduct & Prohibited Activities

You agree that you will not:

  • Use the Site for unlawful purposes, or in violation of any applicable law or regulation.

  • Interfere with others’ use of the Site or disrupt the Site’s operation.

  • Attempt to access restricted areas without authorization.

  • Upload or transmit viruses, malicious code, or any content that infringes intellectual property, is defamatory, obscene, or otherwise illegal.

  • Impersonate others or misrepresent your affiliation.

  • Use data mining, scraping, automated tools to extract content.

Violation may lead to account suspension, cancellation of Orders, or legal action.

9. Intellectual Property

  • All content on the Site (images, logos, text, product descriptions, layouts, software) are owned or licensed by us and protected by copyright, trademark, and other laws.

  • You may use the Site for personal purchase and browsing only. You may not reproduce, distribute, modify, or exploit any part for commercial purposes without our written consent.

10. Disclaimers & Limitation of Liability

  • The Site and Products are provided “as is” and “as available” without warranties, express or implied (e.g. merchantability, fitness for a particular purpose, non-infringement).

  • We do not guarantee that access to the Site will be uninterrupted, error-free, or secure.

  • Our liability for any claim arising out of or relating to these Terms or the use of the Site is limited to the value of the Order in question.

  • We are not liable for indirect, incidental, special, or consequential losses (loss of profits, data, goodwill, etc.).

11. Indemnification

You agree to defend, indemnify and hold harmless Guitar Paradise and its affiliates, employees, agents, from any claim, loss, damage, liability, or cost (including legal fees) arising from:

  • your breach of these Terms,

  • your use or misuse of the Site,

  • your violation of any law or third‑party rights.

12. Force Majeure

We will not be liable for any failure or delay in performance due to causes beyond our reasonable control (e.g. natural disasters, war, strikes, pandemics, government restrictions).

13. Termination

  • We may suspend, restrict, or terminate your access or account, or cancel Orders, at any time and for any reason, with or without notice.

  • Termination does not affect rights or obligations accrued before termination.

  • Upon termination, all rights granted under these Terms will cease.

14. Governing Law & Disputes

  • These Terms are governed by the laws of Bangladesh.

  • Any dispute, controversy or claim arising from or in connection with these Terms or your use of our Site shall be submitted to the exclusive jurisdiction of courts/tribunals in Dhaka, Bangladesh.

15. Communication & Notices

  • We may communicate with you by email, SMS, phone, or posted notices on our Site.

  • You agree to receive such communications in relation to your Orders and use of the Site.

  • Notices to us should be sent via our “Contact Us” channels as listed on the Site.

16. Miscellaneous

  • If any term is held invalid or unenforceable, the rest will remain in effect.

  • A waiver of any term shall not be construed as a waiver of any other term.

  • These Terms constitute the entire agreement between you and us regarding your use of the Site and supersede prior agreements.
